Please read, or re-read, the following sections
thoroughly - they contain vital information should you decide to choose
OffshoreSimple Inc to 'go offshore' with or not as the case may be. If you do
decide to go elsewhere, please, for your own sake, make sure that whoever you do
business with takes the same precautions we do!
Security Matters
Despite what many people who 'go offshore' think, it's not just the
stability and security of the jurisdiction where their company is registered that is of
importance. It is of vital importance to the beneficial owners of offshore companies and
trusts that there is stability and security within the formation company they use.
Whilst we do not decry any of our competitors, OffshoreSimple can assure all their
clients, existing and prospective, that any of the minimal records we do store (PGP
encrypted on optical discs) are kept totally confidential and that it would take a court
order to force us to reveal even the location, yet alone the country where those records
are stored.
It would then take a further court order within that jurisdiction itself to make
us reveal the content of those records.
We have been assured by our lawyers that for such an order to be made, a prima facia case
of either money laundering, drug smuggling or terrorism/illegal arms dealing within that
jurisdiction itself would have to be proven. Tax cases would not stand a chance!
We should also point out that the computers which hold our web site, our administrative
records, our client records and our company formation details are all in different
countries.
We consider this to be of vital importance, not for ourselves, but for you, our Clients.
Keep Your Mouth Shut
As a final word on security, at least for the moment, the vast majority
of cases brought against owners of offshore bank accounts (and companies) for suspected
tax evasion by 'onshore, home country' tax authorities are due to loose mouths,
disgruntled employees or ex-employees, vindictive wives & girlfriends (or ex-),
jealous neighbors or friends or by those who just love to cause trouble for others. If anyone,
repeat, anyone, knows you have an offshore bank account, you could have a
possible problem in the future, even if you are running your business and account totally
legally. Tax authorities tend to work on the highly undemocratic basis of "guilty
until proved innocent", which can be mighty hard to do!

We're quite used to having to help people in using PGP for the first time, sending keys
seems to be the biggest problem, they're frequently sent to us in an indecipherable
format, so don't worry if you don't get it right first time!
Whilst we have no wish to deter anyone from making legitimate purchases
or transferring money to accounts around the globe, care must always be taken over the
inevitable 'paper trail' that most transactions leave.
This must not be underestimated especially by US based clients, real-time monitoring of
financial transactions, especially those going out of the US, is now a reality thanks to
organizations like FinCEN (Financial Crimes Enforcement Network).
FinCEN is a 'quasi-secret' amalgam of the interests of the Internal Revenue Services
(IRS), the Federal Bureau of Investigation (FBI), the Drug Enforcement Agency (DEA), the
Central Intelligence Agency (CIA), the State Department Bureau of Intelligence and
Research (INR), the Secret Service, US Customs and the US Mail. FinCEN also has the
co-operation of the Defense Intelligence Agency and the National Security Agency, with
full access to all their massive resources.
Whilst FinCEN does catch some criminals in the accepted sense of the word, an estimated
90% of its 'catches' are ordinary individuals and small businesses merely trying to keep a
bit of their own money outside the tax-man's knowledge!
Whilst we don't yet have full knowledge of the implementation of this system, FinCEN is
known to have been experimenting with a massive Artificial Intelligence (AI) computer
system linking all the US based banking computers together with those of all
the US based or owned credit card organizations.
Talk about paranoia and intrusion of privacy - this, and some of the associated federal
'financial' crimes like somehow forgetting to complete Form 4789 on a transaction over
USD10,000 - goes way beyond anything the Communist regimes that those same government
agencies so criticized did even in their heyday.
